Can it be used without the top? I’m looking to haul dog fencing that is 40” high.

Hey Don, yes you could use the 24x60 etrailer Enclosed Cargo Carrier for RV Bumper # e34VV without the top section. If you fastforward to about the 6 minute mark of the review video I attached you can see that the sides all bolt together and the top wouldn't have to be added. You might have to scroll down a bit to the "Helpful Info" section.
