Why Does Curt Echo App Say Never Use App While Driving?

Hi, Question about the Curt Echo brake controller: Items arrived well packed and when promised. I have not yet tried installing the controller. I downloaded the One Control Auto app and was surprised that the app requires so much personal information. The end user agreement that must be agreed to before using the app states that I must agree to not use the app while driving: “b. Do Not Use While In Motion. The App must NEVER be used while driving or while the connected vehicle is in motion. Never use the App unless the connected vehicle is properly parked and secured.” I worry that if there is a serious incident due to the brake failing, Curt or Lippert can argue that I broke the agreement by using the brake controller app in motion, for the very use this item is sold.

Hey Andrew, thanks for reaching out!
I definitely get where you're coming from, and it's a little contradictory because you have to make adjustments to the Echo # C51180 controller settings and that can only be done while in motion.
With that being said, I reached out to my contact at Curt so I could give you a response straight from the manufacturer on this. I sent them when you posted here as well as a follow up clarifying that it would be safe to make adjustments while driving during the setup. Here is the official response from Curt:
"Thank you for reaching out! With the disclaimers in the app referring to use of the app while in motion - these are there to encourage you to not be on your phone while driving, for your safety. Even in the event that the phone/app gets disconnected from the Echo, the device will operate on the previous Profile used or Default Setting - keeping you safe with brakes still operating as intended.
These disclaimers sometimes seem over-redundant to ensure you are aware we want you to be safe while traveling. This does not mean you can't use the app during operation of the vehicle while set up/testing brake strength, etc."
So basically, set it up in a safe environment (like an empty parking lot) and then avoid messing with your phone during normal travel. Since you also picked up the Manual Override Button # C83HR you'll be able to stay completely hands-free of your phone while towing!

Jon, Thanks for the response and the effort you put into it. I understand your and Curt’s explanation but I have always regarded software user agreements as legal agreements between the user and the provider of the app written in quite concise legal language. Given the consequences of being distracted by an app during freeway driving I agree that driving with the app off, while the brake continues to function as last setup, is probably the best choice. I do worry that I could fail to notice a controller malfunction due to a bad contact developing but the trailer braking is something you can generally feel and you could test the app at every stop. The brake controller has worked as advertised in my off road setup so I’m looking forward to trying it on the interstate.
