Is the 8-3/8 inch measurement to the tall part of the bike rack?

Great question, Elijah!
The 8-3/8" measurement you're talking about for the Benton ShiftShow Bike Rack # B94FR is to the bracket that the mast rotates on. From the center of the hitch pin hole to the mast itself is 11-1/2" but that's towards the bottom. the rack naturally has a backwards leaning angle so the higher you go the less clearance you have.
