Since you are looking for a step that can be used with your tailgate down, I recommend taking a look at the HitchMate Extendable TruckStep, # HE4045. This step was designed for that specific purpose and offers a support strut that extends step platform up to 23-1/2" from your receiver opening. Check out the picture that I have attached.

As for the WeatherTech BumpStep Hitch-Mounted Bumper Protector and Step, # WT81BS1, that you referenced, this measures 9-1/2" from the center of the last pin hole to the edge of the step. Whether you will be able to use this step with the tailgate down is going to depend on your hitch receiver as well as the style of your tailgate. You will want to measure 9-1/2" out from the center of the hitch pin hole on your truck's trailer hitch receiver to see exactly where the edge of the step would be when mounted.
