Sounds like you either have the Draw-Tite Class II # 36334 or Class III # 75560 hitch receiver for your 2006 Subaru Legacy. While this is a custom fit hitch that should bolt right up no problem, the mounting brackets may have become bent during shipping which is why you're having issues getting the bolt holes to line up (if you're talking about something else please let me know).
This is common enough that we actually have a helpful article on how to handle this type of situation which I'm linking for you to check out. Ultimately as long as the integrity of the hitch hasn't been compromised you'll be good to flex it back into shape so it properly fits the vehicle.
If the Draw-Tite hitch is a different part number then it doesn't fit the 2006 Legacy and you'll need to swap it out with one of the options above. I recommend the Class III # 75560 because it has the larger 2" receiver opening. Attached is an installation video for you to check out.
