Question:

With the third row in use, does the mat fold flat or do you really have to remove it? If you decide you need to use the third seat while running around, the cargo mat could be a problem.

On the 2008 to 2011 Toyota Highlander, the WeatherTech Cargo Liner, part # WT42328, is designed to roll up towards the cargo area when the third row is in use. When the third row is folded down, then the cargo mat will lay flat and cover the whole cargo area behind the second row seating. You will not need to remove the cargo mat to use the third row seating.

what about the 2004 model? Can 3rd row seating be used?

For a 2004 Highlander, you would use either WT41201 for tan, WT42201 for gray or WT40201 fro black. You do not HAVE to remove the liner, it is flexible enough you can bend it up with the 3 row seat backs up. However, it may not sit perfectly flat on the cargo area floor.
