Question:
Does this get in the way with the spare tire. I dont see the spare tire mounted in the pictures. I am torn between 13573 and 75371. I have the 2008 BMW X3 3.0 any recommendations

The spare tire on your 2008 BMW X3 will not be affected in any way with a trailer hitch installed so no worries there.
Both the Curt trailer hitch # 13573 and Draw-Tite # 75371 have the same rating, 350 pounds tongue weight and 3,500 pounds gross trailer weight, and install in basically the exact same way. Given that the Curt hitch cost a little less it would be a good option. I have included a link to the installation instructions to the right.
If you plan on doing any towing I recommend etrailer ball mount kit # EBMK4. It comes with a ball mount, interchangeable ball set, hitch pin with clip, and a storage bag. And for trailer wiring use # C59236. I have linked a video showing installation on a 2013 X3 for you.
